Tibco Sues Apple Over Trademark

Enterprise application integration software developer Tibco Software Inc. announced yesterday its going after Apple.

Tibco, of Palo Alto, Calif., is suing Apple Computer Inc. for trademark infringement.

The suit, filed in the District Court for the Northern District of California, alleges that Apple infringed on Tibcos trademarked Rendezvous product name, with the intention to trade on Tibcos good will and harm its business, according to the company.

Rendezvous is the messaging system foundation for Tibcos ActiveEnterprise line of e-business infrastructure products.

In the suit, Tibco said that it has been using the Rendezvous trademark since 1994 and its Tibco Rendezvous trademark since 2000, in conjunction with its software.

Apple, on the other hand, has been using the Rendezvous name since 2002 to describe software closely related to Tibcos software.

Tibco said that when Apple began using the trademark, it was already aware of Tibcos software.

“Rendezvous has been a Tibco mark for many years and is one of our flagship products,” said George Ahn, chief marketing officer, in a statement. “For quite some time we have tried to reach an amicable agreement but, given Apples continual refusal to honor our trademark, we have been forced to take action.”

“Apple does not comment on pending litigation,” an Apple spokesman said.
