GAO Report: Legal Uncertainties Slow Health IT

The Department of Health and Human Services spends about $228 million over 19 health information technology initiatives, but unclear federal laws discourage health care providers from adopting new technologies, says a report released by the Government Accountability Office.

According to the GAO, “healthcare providers are reluctant to take action and make significant investments in health IT” because of legal uncertainty. They fear using new health information technology systems may cause them to run afoul of a litany of laws. involving fraud and abuse, antitrust, federal income tax, intellectual property, malpractice and state licensing.
