The fact that DoJ staff is recommending against Oracles takeover of PeopleSoft means the deal is probably dead. Case in point: Richard Gilbert, former deputy assistant attorney general for antitrust in the Clinton administration, says that of the nearly 100 cases he worked on with Assistant Attorney General R. Hewitt Pate, there were only some five in which Pates final decision veered away from staff recommendations.
