      eWEEK EDITORS CHOICE CONTEST RULES

      NO PURCHASE NECESSARY. To enter the contest, visit /article2/0,1895,2008232,00.asp. A completed entry form must have your first and last name, e-mail address, telephone number and age (you must have a valid email address to participate in this contest). Entries must be received between August 23, 2006 and 11:59 pm (Eastern Standard Time) on September 1, 2006. Ziff Davis Media Inc. (“Ziff Davis” or “Sponsor”) assumes no responsibility for lost, misdirected or late entries or entries containing incorrect or incomplete information. Winners notified by e-mail must respond within seven (7) calendar days or an alternate winner will be chosen. Contest site contains a list of twenty-five (25) eWEEK stories published within the last month. Contestants must check/select five (5) of the stories which he/she thinks are the most relevant. Those contestants who select the same five (5) stories as eWEEK Editor Michael Vizard will be entered into the random drawing. Sponsor shall select the prize winners on or about September 8, 2006 by random drawing from among all eligible entries received. Winners will be notified by e-mail, telephone or regular mail. The only entries that will be considered eligible entries are entries received within the time frames described above that contain the required information. Odds of winning depend on number of eligible entries received.

      All prizes will be shipped to the winners within 6-8 weeks of the receipt of signed affidavits for approved entries. Prizes are not transferable. No substitution of prizes for cash or other goods or services is permitted, except Sponsor reserves the right to provide substitute prizes of approximately equal value. Prize winners are responsible for all taxes related to any prize received. Actual retail value of prizes may vary due to market conditions.

      The contest is open to legal residents of the 50 United States and the District of Columbia, who are eighteen (18) years or older at the time of entry. Only one entry per person. More than one entry from any person or email address may void all entries from that person or email address. Employees of Sponsor and its affiliates, and immediate family members of such employees, are not eligible to enter. This contest is subject to all applicable laws and is void where prohibited. By participating in this contest, entrant agrees to abide by and be bound by these rules and the decision of the Sponsor, which shall be final and binding. All submissions become the sole property of Sponsor and will not be acknowledged or returned. WINNER ASSUMES ALL LIABILITY FOR ANY INJURIES OR DAMAGE CAUSED OR CLAIMED TO BE CAUSED BY PARTICIPATION IN THIS CONTEST OR BY THE USE OR MISUSE OF ANY PRIZE. By entering the contest, each prize winner grants Sponsor permission to use his or her name, city, state/province, e-mail address, photograph or likeness, voice and entry for advertising, publicity or other purposes without additional consent and compensation except where prohibited by law. Each prize winner must be eighteen (18) years or older, and will be further required to submit an affidavit of eligibility and a liability/publicity release and confirmation that the prize winner has followed the rules of the contest, in the form supplied by Sponsor (the “Affidavit and Release”), signed by the prize winner. The Affidavit and Release must be signed and returned within seven (7) days of notification. In the event of non-compliance within this period, an alternate winner may be selected for such prize. Any prize notification or prize returned to the Sponsor as undeliverable will result in the awarding of that prize to an alternate winner (who will be required to comply with similar procedures).

      BY ENTERING THE CONTEST, EACH ENTRANT RELEASES SPONSOR, ITS SUBSIDIARIES, AFFILIATES AND BUSINESS PARTNERS, AND THE EMPLOYEES, DIRECTORS, OFFICERS, AGENTS, ATTORNEYS, SUCCESSORS AND ASSIGNS OF ANY OF THE FOREGOING, FROM ANY AND ALL CLAIMS OR LIABILITY, INCLUDING BUT NOT LIMITED TO DAMAGES, LOSSES OR INJURIES, SUFFERED BY THE ENTRANT OR ANY THIRD PARTIES IN CONNECTION WITH PARTICIPATION IN THIS CONTEST OR ACCEPTANCE OR USE, MISUSE OR MALFUNCTION OF ANY PRIZE AWARDED. By entering the contest, entrants acknowledge compliance with these contest rules (including without limitation all eligibility requirements). All matters relating to the interpretation and application of these rules shall be decided by Sponsor in its sole discretion. By entering the contest, entrants and prize winners grant Sponsor permission to use his or her name, address, email address, photograph and likeness, voice and entry for advertising, publicity or other purposes without additional consent or compensation except where prohibited by law. By entering the contest, entrants consent to receive notification of future promotions, advertisements or solicitations by or from Sponsor or Sponsors business partners, via email, direct mail, or other means of communication. For names of prizewinners after September 12, 2006 send a stamped, self-addressed No. 10 envelope to eWEEK Editors Choice Contest, Ziff Davis Media Inc., 28 East 28th Street, New York, New York 10016, Attn: Online Audience Development, 12th Floor.

      In the event of any dispute, entries made by Internet will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. Authorized account holder is deemed as the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. If the potentially winning entry is an Internet or other computer entry, potential winner may be requested to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the potentially winning entry. If for any reason (including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this contest) the contest is not capable of being conducted as described in these rules, Sponsor shall have the right, at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the contest. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. Sponsor is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof, including, without limitation, any injury or damage to participants or any other persons computer related to or resulting from participating or downloading any materials in this contest.
